As mentioned I’ve talked to a lawyer-musician here who says the tucson panhandling law distinguishes tween panhandling
and busking. That doesn’t mean the city can’t pass a law banning busking too.
The sine qua non for panhandling is accosting people
and asking for money as in ‘Spare change?’ I believe this is usually reflected in the laws as well. The laws I’m familiar with that ban both panhandling and busking in the same law nonetheless distinguish between the two. The former alone is considered begging. The rationale for the anti-busking part of such a law tends to flow from concerns about excessive noise–the saxophone under your window playing jazz loud.
